Temporary Skills Shortage Visa 482 (Class GK)

This is a temporary visa, allowing the applicant to remain in Australia for up to four years and may lead to permanent residence after two years under the Employer Nomination Scheme 186 (Class EN), via the Temporary Residence Transition Scheme. Throughout the duration of the 482 visa, the applicant must remain in their nominated occupation and the sponsor must maintain terms and conditions of employment that are no less favourable than those that would apply to an Australian citizen or permanent resident doing equivalent work in the same workplace, including salary, hours of work and leave entitlements.

Processing is currently estimated at three (3) months and the following expenses are likely to be incurred:

  • Sponsorship: $420
  • Nomination: $330
  • Base Application Charge: $1,035
  • Additional Applicant Charge – over 18: $1,035
  • Additional Applicant Charge – under 18: $260
  • Skills Assessment (if required): fee payable to supplier
  • IELTS Test (International English Language Test – if required): $330
  • Health Insurance: approximately $1,000 per year;
  • Australian Federal Police check: $42
  • Overseas Police checks (if required): fee payable to supplier
  • Representation by Migration Lawyer: $2,200 (inc GST).

Requirements for this visa include:

  • Sponsor lawfully operating
  • Genuine need for the sponsor to employ a paid employee to work full-time in the position under the nominator’s direct control
  • The position cannot be filled by local workforce: Labour market testing required except where the international trade obligations apply
  • The guaranteed annual earnings will be over $53,900pa (plus superannuation)
  • Aapplicant has the skills required to perform the tasks of an occupation on the relevant Skilled Occupation List (skills assessment required for applicants holding certain passports and performing certain trades eg cook, chef, carpenter)
  • At least two (2) years’ relevant work experience in the nominated occupation or a related field
  • English:
  • Short-term stream: eg IELTS overall band score of at least 5.0 with a score of at least 4.5 in each of the test components
  • Medium-term stream: eg IELTS overall band score of at least 5.0 with a score of at least 5 in each of the test components
  • Short-term stream: Genuine Temporary Entrant

In order to demonstrate the above requirements, the following documents are required:

From the employer

  • Completed Sponsorship application;
  • Completed Nomination application;
  • Form 956 appointment of representative;
  • Record of Australian Business Number (ABN) registration;
  • Record of ASIC registration of Australian company Number (ACN);
  • Certified photocopy of financial reports for the most recently concluded financial year, including profit & loss statement indicating expenditure on payroll and training;
  • Certified photocopy of Business tax returns for the most recently concluded financial year;
  • BAS statements for the 12 months preceding the application;
  • Website extract or other marketing material;
  • Evidence of job advertisements for the nominated positions, including copies of ads and invoices for fees;
  • Evidence of employment of all staff eg PAYG withholding statement;
  • Evidence of Australian visa status of all workers (eg copies of Passports, visas etc);
  • Applicant’s signed employment contract including Position Description;
  • Signed employment contracts for equivalent Australian employees;
  • Company structure chart;
  • Copy of Company constitution;
  • Statement regarding labour market testing.

From the primary applicant:

  • Completed application form;
  • Health Declaration;
  • Form 956 appointment of representative;
  • Curriculum Vitae (CV);
  • Certified photocopies of relevant Educational Certificates and transcripts – Not applicable;
  • Evidence of previous employment eg tax statements, employer references etc;
  • Certified photocopy of Passport ID page;
  • One Passport-sized photograph with the applicant’s name inscribed below / behind;
  • Evidence of health insurance;
  • IELTS test results indicating scores over 5 in each band of reading, writing, listening and speaking;

From the secondary applicant

  • Form 956 appointment of representative (draft to be provided);
  • Certified photocopy of Passport ID page;
  • Certified copy of Birth / Marriage / Registered Relationship Certificate;
  • Evidence of currently living together eg copy of tenancy agreement;
  • Evidence of health insurance.
